1. ACCEPTANCE OF TERMS OF USE

This website, platform and any service offered under the name VIP Private Chef (“Platform”) is operated and owned by VIP Private Chef (ABN 16186408156) and its related entities or body corporates (“us”, “we” and “our”).

Your use of this Platform is subject to these terms of use (“Terms of Use”). The Terms of Use constitute a binding legal agreement between you and us, and your continued use of the Platform constitutes your acceptance and acknowledgement of these Terms of Use, our Privacy Policy, and any other policy displayed on the Platform, all of which constitute a part of the Terms of Use. If you do not agree to the Terms of Use, you must not use the Platform.

Any time you visit the Platform, sell or purchase any goods or services on or through the Platform, or enter into any transaction on or through the Platform whatsoever, you are taken to accept these Terms of Use.

We may amend or modify the Platform, the Terms of Use and/or any policy at our sole discretion and at any time. Any amendments are effective 14 days after publication on the Platform. Your continued use of the Platform indicates your continued acceptance of the Terms of Use as modified.

These Terms of Use will prevail over any other terms or agreement between you and us.

 

2. BOOKING OF VIP Private Chef SERVICES; FEES; PAYMENT

Upon a Customer booking an event service, the customer shall pay a non-refundable $200 flat fee to hold the date. Within 7 days of holding the date, we will liaise with you to finalise your anticipated numbers and menu design. The Customer shall then pay a 30% deposit based on the expected numbers. Final numbers are to be confirmed 3 days before your event, the remaining amount of the payment is due upon arrival at the event service.

If the Customer cancels his/her/its reservation request they will forfeit any deposits paid in accordance with the cancellation policy.

 

3. CANCELLATION POLICY

If you are unable to hold your event on the date secured, the initial $200 will be forfeited. VIP Private Chef will make every effort to reschedule bookings. If you cancel your event you will forfeit the $200 fee and the 30% deposit. If you cancel your event within 1 week of the event, you will forfeit 50% of the entire cost of the event.

 

4. PRIVACY AND INFORMATION DISCLOSURE

 

VIP Private Chef’s Privacy Policy explains to Customers how their information is collected and used.

 

5. INDEMNITY

Customers agree to indemnify and hold VIP Private Chef, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of a Customer’s use of the Service, a Customer’s violation of the TOS, a Customer’s breach of any of the representations and warranties herein, or a Customer’s violation of any rights of another.
